Senior Inhouse Counsel

We are pleased to announce the following vacancies within our Legal and Regulatory Services Department. In keeping with our current business needs, we are looking for people who meet the criteria indicated below:

SENIOR INHOUSE COUNSEL (3 POSITIONS)
REF:CA-SIHC-NOV08

Reporting to the Principal In-House Counsel – Real Estate & General Advisory or Principal In-House Counsel – IP & Commercial Advisory, the candidate will provide the company with skilled & professional legal services, with emphasis on drafting, reviewing & research of legal or quasi legal documentation relating to the wide-range of property (Conveyancing) and Commercial activities of the department and providing general legal guidance to the business in accordance with its dynamic needs.

Key Responsibilities

  • Undertake the verification, negotiation and completion of lease agreements including the updating of legal information on the site acquisition database (Oracle Property Manager);
  • Ensure quality control on the drafting / preparation of legal documents required in the roll out for all leased sites or premises;
  • Flag & notify relevant internal customers on the statutory requirements for site acquisition and location of facilities;
  • Diligently perform litigation management tasks for suits arising from properties under the legal counsels’ portfolio;
  • Attend to legal issues relating to the company’s other real property portfolio e.g. retail shops, residential leases;
  • Implement the established contract review and drafting processes within the approved ISO procedures and departmental Service Level Agreement;
  • Ensure quality control in the drafting/preparation of commercial contracts and legal advice and ensure all contracts are drafted, reviewed or completed in a timely manner and upon consultation with the relevant department, and make all necessary additions & alterations as are necessary to contractual documents in order to protect the best interests of the company and for the realization of the company’s business objectives;
  • Constantly liaise with Commercial, Enterprise and New Products Divisions and Marketing Department on launching of new products and services and provide advice on protection of the company's intellectual property;
  • To undertake detailed legal opinions on business-related, Commercial and Conveyancing matters that require statutory interpretations;
  • Ensure cost control of legal fees to external counsel for lease completion and commercial briefs within the agreed rates or as per the Advocates Remuneration Order;
  • Facilitate & coordinate court attendances by Safaricom staff for legal matters relating to the company.

Minimum Requirements

  • A Degree in law from a reputable Commonwealth University, with a minimum 2nd Class Honors and completion of the Kenya School of Law Diploma;
  • Advocate of the High Court of Kenya of at least 3 years standing;
  • Post graduate diplomas or certificate courses in legal matters such as arbitration / mediation, IP e.t.c;
  • At least 3 years experience in Conveyancing and Commercial law, with basic experience in criminal & civil procedure codes, traffic / insurance matters, etc;
  • Working knowledge of telecommunications legal and regulatory environment;
  • Excellent Communication and Interpersonal skills;
  • Good Planning and Organizational skills;
  • Good problem solving and evaluation skills.
