Migration Policy Consultant

POSITION TITLE: Migration Policy Consultant
DUTY STATION: NAIROBI, KENYA
CONTRACT DURATION: 3 MONTHS

Nature of the consultancy: Legal and regulatory policy framework review and development provided to the Department of Immigration through IOM MRF Nairobi.

Job Description:
Under the overall supervision of the IOM Regional Representative and direct supervision of the Regional Technical Cooperation Project Manager in cooperation with the Department of Immigration, the Consultant will develop an immigration policy for the Kenya Department of Immigration according to the guidelines provided by the department and' assistance from relevant units in IOM HQ.

Essential functions will include:

  1. Collect relevant legal information relating to the migration process, and the control and management of irregular migration.
  2. Build up a comprehensive set of reference material for use by the project and inclusion in the Immigration Resource Centre
  3. Review current legal provisions and procedures at borders and other entry points.
  4. Review travel document systems and the integrity of travel document issuance systems and align them with world best practice.
  5. Provide support and legal advice to CBMM and Immigration officers who may be engaged under legislative review provisions of the project.
  6. Provide assistance and advice concerning the preparation and organization of workshop(s) related to the development of the policy
  7. Organize and facilitate a stakeholders workshop to deliberate on the draft policy document and make revisions as will be deemed necessary
  8. Review AU Common Position on Migration & Development and align policy with the position.
  9. Review Draft Immigration Bill and realign it with policy document
  10. Draft a Cabinet Memorandum and present it to the PS in the Ministry of IMMIGRATION & Registration of persons
Desirable Qualifications :
  • Advanced university degree in law with demonstrated expertise in international or migration law.
  • Five years progressively responsible experience in providing legal advice to government and civil society stakeholders, at least three of which in Africa and preferably in Kenya, familiarity with international law and legislation, specifically migration laws and policies,
  • Proven ability to review and draft legislation,
  • Ability to work at strategic and policy levels, including in politically sensitive environments,
  • Demonstrated ability to identify, approach, and coordinate with stakeholders of diverse backgrounds and levels of expertise,
  • Excellent communication skills, both written and verbal,
  • Ability to work under time and political pressure and meet deadlines,
  • Ability to work independently with a minimum of supervision,
  • Computer Skills in Microsoft Office, research and queries through internet, and electronic mail.
  • Excellent command of spoken and written English.
