Care Kenya Careers: Scope of work for the Pastoral Production Groups (PPGs) Legal Registration

1. Purpose

The purpose of these terms of reference is to detail the scope of work for the legal registration of PPGs supported by CARE’s Livestock Purchase Fund (LipFund) project.

The assignment seeks to explore the available legal options for the registration of Pastoralist Production Groups (PPGs) currently operational in Garissa, Wajir, Mandera, Moyale and Isiolo
districts into legal entities.

2. Background

2.1 CARE International Kenya:

CARE International in Kenya (CIK) was founded in 1968 as a development and humanitarian organization whose purpose is to reduce poverty and provide relief in emergencies.

CARE Kenya works with poor communities in North Eastern, Nyanza and Western provinces as well as informal settlement areas of Nairobi.

2.2 LipFund

LipFund project’s goal is to improve the livelihoods of the pastoralists and ensure food security by increasing their incomes and reducing the impact of HIV/AIDS among the participating communities.

The components of the LipFund model include working with grassroots community groups engaged in livestock production and trade herein referred to as Pastoralist Production Groups (PPGs).

The aim LipFund is to ensure that PPGs have capacity and are able to engage effectively in
the livestock sector.

3. The objectives of the legal consultancy

The overall objective of this consultancy is to explore the available legal options for the registration of PPGs and an Apex group as legal entities to allow them engage in businesses and other relevant activities including accessing credit to enhance the productivity and profitability of their businesses.

The specific tasks will include:
  • Review and document the current status of the PPGs. This will entail field visits and holding discussions in the field with PPGs representatives and other stakeholders
  • Explore and avail different legal registration options for the registration of PPGs and the apex organization as legal entities
  • Organize and facilitate feedback workshop for both PPGs, stakeholders and CARE on the available legal operations and their requirements including cost.
  • Provide a comprehensive report that will include among others detailed procedures for each of the options for the registration of PPGs focusing on timeline, requirements, legal procedure and costs.
4. Brief background of Pastoral Production Groups (PPG’s)

The Pastoralist Production Groups (PPGs) are grassroots community based institutions initiated and formed by the local people who are engaged in livestock and livestock products.

CIK took the initiative to support the groups during the Livestock Marketing Enterprises (LIME) project.

The groups have been trained on group dynamics, constitution making, gender and equity, livestock marketing and production and linking to terminal markets, leadership and governance and finance and administration..

5. Methodology of undertaking the assignment

Participatory consultative process will be used where representatives of the PPGs will be engaged in discussions and different options presented on the legal registration of groups.

The consultation process will target the PPGs, CARE program staff and other stakeholders in the livestock sector particularly in northern Kenya.

6. Duration of the Assignment

It is proposed that the assignment will take a maximum twenty one working days, which will include the reviewing/exploring existing legal registrations for community groups, travelling; feedback workshop for PPG’s and report writing.

7. Deliverables

The hired consultant will be expected to
  • Hold Feedback session with PPGs, stakeholders and CARE and submit a report of the session
  • Submit of a comprehensive report on the recommended legal options including pros and cons of each, cost and time-frame
8. Commencement and report writing
  • The consultancy is proposed to start on the last week of Nov. 2009 for 21 working days.
9. Liaison and communication

The legal consultant will work under the supervision of the LipFund Project Manager and closely with the ARC Project manager, LipFund project, Social Development Officers, Program Manager Enhancing Livelihoods in the Mandera Triangle (ELMT) based in Garissa

CARE will provide background information and requisite documents on LipFund, accommodation, materials for the orientation workshop; transport to and from the field and per diem at CARE International Kenya rates.

The consultant’s will provide working equipment including computers and will be expected to submit the draft report not later than seven (7) working days after completion of the assignment. Final report will be expected 5 days after the feedback workshop.
