The Privatization Commission is a body corporate established under the Privatization Act 2005 to implement Kenya's Privatization Programme.
Following the approval of the Privatization Programme by the Cabinet, the Commission invites Expressions of Interest for transaction advisory services for the following transactions:
- National Bank of Kenya Ltd;
- Kenya Pipeline Company Ltd;
- Privatization of public sector owned sugar companies (one consultant for all companies);
- Privatization of public sector owned hotels (one consultant for all hotels); and
- Kenya Wine Agencies Ltd.
For each of the transactions, the consultant will be required to:
- Carry out financial, legal and technical due diligence;
- Recommend the most appropriate privatization strategy for each of the companies;
- Carry out valuation of the company/companies;
- Advise on the appropriate share structure and restructuring of the company/companies;
- Prepare Information Memorandum and other relevant documents;
- Facilitate discussions between the Commission and the shareholders and other stakeholders;
- Facilitate procurement of other consultants required to implement the transaction and coordinate their activities;
- Advise the Commission on all the requirements for the recommended sale strategy;
- Take part in roadshows; and
- Provide any other service as may reasonably be required of a Transaction Advisor.
The Privatization Commission will prepare the short list of firms to whom the request for proposals (RFPs) will be later distributed. Consultants will be selected in accordance with the public sector procurement procedures set out in the Public Procurement and Disposal Act (2005) and the Public Procurement and Disposal Regulations (2006).
The consultant can express interest in either one or all of the consultancies. Expressions of interest must be received at the address below by 12.30 pm, 20th January 2009
