The Republic of Kenya is party to most of international and regional conventions and protocols related to human rights of women and gender empowerment and equality. In the last five years the Government has taken progressive steps to address the issue of the sexual and gender based violence through adoption and implementation of broad national policies and strategies and substantive laws, including the 2006 Sexual Offences Act. This Act specifically regulates responses to the crimes of sexual and gender-based violence, defines sexual offences and establishes minimum sentences, as well as provides for victim protection/treatment and progressive practices in the investigation and prosecution. In 2008, the Attorney General of the Republic of Kenya established a Section on Prosecution of Sexual Offences in the Department of Public Prosecutions of Kenya (DPP) dealing with sexual and gender-based violence offences. In addition, the Kenya Police established gender desks in several stations throughout the country to ensure that cases of gender-based violence are reported to the Police and that victims have access to support services. Despite progress in this area, there are a number of challenges that prevent victims of sexual and gender-based violence to access legal justice and have their rights protected and restored. Most of gender-based violence cases remain unreported by individuals who often face obstacles in trying to bring the alleged perpetrators to justice.
In view of the above and the request from DPP and the National Task Force on Implementation of the Sexual Offences Act (NTF SOA), UNODC, in collaboration with the German Technical Cooperation (GTZ), initiated the process for developing a training manual and curriculum for Prosecutors and Police officers to improve their knowledge, skills and competence in handling cases of gender-based and sexual violence and provide necessary support to victims. The consultant will be assigned to UNODC Office for Eastern Africa, based in Nairobi, Kenya and will work under supervision of the UNODC ROEA Criminal Justice Expert and GTZ CBV Component Leader.
Duties and Responsibilities
The main objective of the assignment is to develop training manual and curriculum for Kenya Prosecutors and Police officers to strengthen their capacity to effectively respond to gender-based and sexual violence in line with applicable legislation and international standards. The manual shall also include measures to prevent sexual violence against women and children, ways to respond to and investigate acts of violence, including forensic investigation, and resources to meet the needs of victims with specific focus on assistance and rehabilitation.
The objective will be achieved through performance of the following tasks:
• Conduct research and desk review of existing training manuals, curricula and materials as well as the existing legislative framework regarding sexual offences and gender-based violence in Kenya, including:
• 2006 Sexual Offences Act with Amendments of 2007 and 2009 and regulations therein
• 2006 Witness Protection Act with Amendment of 2010 and regulations therein;
• State Law Office Reference Manual for Prosecutors on sexual offences;
• Police Training Manual on Gender and Human Rights (FIDA, 2008);
• Draft rules of court on sexual offences;
• Draft training materials for police prosecutors developed by the WJEI Senior Legal advisor;
• Judgments and recent jurisprudence emerging from the courts on SOA and their implications;
• National Guidelines on management of sexual violence in Kenya (Ministry of Public Health and Sanitation, 2009) and other relevant materials.
• Develop a comprehensive training manual and curriculum on sexual offences and gender-based violence for Prosecutors and Police officers, based on the revised and updated United Nations Model Strategies and Practical Measures to Eliminate Violence against Women in the Field of Crime Prevention and Criminal Justice
and on the UNODC Handbook on Effective Police Responses to Violence against Women and the related Training Curriculum, adapted to the local needs. The training material will be also based on methodologies and principles of adult learning.
• Conduct the initial ToT workshop for a selected group of Prosecutors and Police officers, based on the developed manual and curriculum, with participation of representatives of key victim assistance services. The training also intends to test the draft training material, which shall be revised based on the lessons learned/ feedback from the workshop.
• Develop model Charge Sheets under the SOA and Penal Code on SGBV;
• Provide interim and final reports, including recommendations for further training needs of the beneficiary, as well as development of the protocols and standard operating procedures (SOPs), submitted at the end of the assignment respectively.
The consultant will report to UNODC Criminal Justice Expert and GTZ GBV Component Leader and be based in Nairobi, Kenya. The consultancy will include two (2) travels to Nairobi, Kenya. UNODC and GTZ will provide necessary support to the consultant.
Competencies
• Strong interpersonal and communication skills.

• Good analytical and drafting skills.
• Computer literacy.
• Oral and written fluency in English.
Required Skills and Experience
Education:
• Master's Degree in criminology, law, sociology or related discipline.
Professional experience:
• At least 5 years of relevant professional experience in and extensive knowledge of investigation and prosecution of cases of gender based and sexual violence;
• Extensive professional experience in the area of training on issues of sexual and gender based violence, including in international settings;
• Proven and extensive experience in the development of training curricula and materials;
• Ability to interact with governmental agencies, good interpersonal skills and organizational proficiency;
• Excellent communication and drafting skills in English, both orally and in writing;
• Knowledge of the criminal justice system in Kenya and Eastern Africa is highly desirable.
Other considerations:
• The assignment will be billed monthly based on a daily rate. The daily rate is payable against actual working days dedicated to the project as well as monthly progress reports.
